gPotato Promotion Official Rules

1. Sponsor: Gala-Net Inc. ( “Sponsor”), owners of the gPotato Game Portal at http://www.gpotato.com ("Website"), 555 North Mathilda Ave, Suite 220, Sunnyvale, CA 94085.

2. Eligibility: Employees, directors and officers of the Sponsor, its parents, affiliates, subsidiaries, advertising or promotional agencies, and their immediate family members (including spouse, parents and step-parents, siblings, and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) and/or those living in same household of such employee are not eligible.

The event is subject to all applicable federal, state, provincial, territorial, municipal, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the event. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. PRIVACY: Except as otherwise stated in these official rules, the use of the information each entrant submits for the event is governed by the Gala-Net Inc. privacy policy, which can be found at http://www.gpotato.com.

4. How to Enter: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

The event begins and ends as written by the Sponsor on the event’s web page. To participate in the event, entrants must follow the instructions written by the Sponsor within the designated time period.

For events conducted primarily on the Website, entrants must be a registered member of the Website. Only registered members are eligible to win. To create a free gPotato account, go to the Website and enter the required information. All entrants must have valid e-mail address and it is the entrant's responsibility to update the Sponsor of any change in their e-mail address. By participating, entrants acknowledge that they are registered on the Website, and may periodically receive email updates about the event from the Sponsor on the account they have received by registering on the Website.

For events conducted on a site external to the Website, entrants must follow the guidelines set by the external website in addition to the guidelines set by the Sponsor.

Entrants acknowledge that utilizing scripts, macros, or other automated and illegitimate means to play the game will be regarded as illegitimate, and Entrants will be disqualified from the event, at Sponsor's sole discretion. Sponsor is not responsible for lost, late, incomplete, or illegible entries; bugs; failures in servers, hardware or software; transmission failure or loss or delayed or corrupted data transmissions or any injury or damage to an entrant's or any other person's computer related to or resulting from the event. In the event of a dispute concerning who registered to participate in the event, the registration will be declared to have been made by the authorized account holder of the email address submitted at time of registration. An authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

Each selected entrant will be notified via email that he or she, subject to verification, is an event winner. If selected event winners cannot be reached after a reasonable effort has been made during ten (10) business days from Sponsor's first attempt, or if a winner is found to be ineligible at Sponsor's sole discretion, an alternate winner may be selected. If a prize or prize notification is returned as undeliverable, the selected winner may be disqualified, and an alternate winner may be selected.

5. Prizes: Prizes and how to win them will be listed on the Website or external website.

No transfer, cash or prize substitution allowed, except at Sponsor's sole discretion. Sponsor reserves the right at its sole discretion to substitute any of the Event prizes for a prize of equal or greater value.

6. Verification of Potential Winners: Winners must provide all requested documents for verification and documentation purposes. Prizes won by minors will be awarded to their parents/legal guardians. It is required that the winner be at least age eighteen (18) to receive these prizes. Winners between the ages of thirteen (13) and seventeen (17) are eligible to win prizes pending parents' or guardians' prize verification. Decisions made by Sponsor are final in all matters, including interpretation of these official rules and awarding of the prizes. A contestant can only win once. If legitimately claimed, all prizes will be awarded. In no event will more than the stated number of prizes be awarded. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNTIL ENTRANT ’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.

7. Odds of Winning: The odds of winning a prize in the event depend upon the number of eligible participants.

8. LIMITATION ON LIABILITY / DISCLAIMER / OTHER REQUIREMENTS: All entrants agree to be bound by these official rules and the decisions of Sponsor. Except where prohibited by law, by entering the event, each entrant consents to the use of his/her name, voice, picture, likeness, and biographical data and/or any other information contained in his/her entry in advertising, promotional, and marketing materials by Sponsor and the Sponsor affiliates in all media now known or hereafter discovered without additional compensation, notice, review, or approval. All entrant s further acknowledge that if they are chosen as a winner, parts of their personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, being on a winners list. If the event is not capable of running as planned, including, without limitation, because of any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or other cause beyond Sponsor's control which corrupts or threatens to corrupt or adversely affects the administration, security, fairness, integrity, or proper conduct of the event, Sponsor reserves the right, in its sole discretion, to cancel, suspend, and/or modify the event and Sponsor, in its sole discretion, can choose the winner with the highest score from among all eligible entries received prior to such cancellation, suspension, or modification of the event. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. EACH WINNER, BY ACCEPTANCE OF A PRIZE, AGREES TO RELEASE SPONSOR AND THE SPONSOR AFFILIATES FROM ANY AND ALL LIABILITY, CLAIMS, OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURIES, DEATH, DISABILITY, ATTORNEYS' FEES, COSTS OF LITIGATION, AND SETTLEMENT, AS WELL AS DAMAGES OR LOSSES TO PERSONS AND PROPERTY THAT MAY BE SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP, OR USE OF ANY PRIZE OR WHILE TRAVELING TO AND/OR FROM A LOCATION TO OBTAIN OR USE ANY PRIZE. NEITHER SPONSOR NOR THE SPONSOR AFFILIATES MAKE ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, RE-ROUTING, OR ACTS OF ANY GOVERNMENT OR AUTHORITY.

Neither Sponsor nor the Sponsor affiliates are responsible for technical, hardware, software, cable, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications caused by Sponsor or the Sponsor affiliates, the entrant , any entrant challenged in the event, or by any of the equipment or programming associated with or utilized in the event or by any human error which may occur in the processing of the entries in the event and/or which may limit an entrant 's ability to participate in the event. Further, neither Sponsor nor the Sponsor affiliates are responsible for any lost, late, illegible, misdirected, mutilated, incomplete, or postage-due mail. Entries that are incomplete, illegible, or corrupted are void and will not be accepted. Any person who supplies false information, enters by fraudulent means, or is otherwise determined to be in violation of these official rules in an attempt to obtain any prize will forfeit the prize won and may be prosecuted to the fullest extent of the law. Each entrant agrees not to knowingly: damage or cause interruption of the Event; prevent others from using the event; or obtain or modify another entrant’s non-public account information without their consent. Submission of an entry is acknowledgment of an agreement to be bound by all terms and conditions of these official rules. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE EVENT VIOLATES CRIMINAL AND/OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY EVENT AND ENTRANT MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
